Reflection #1

In my article Last Place for Justice- If at All I mentioned a case that I had against the State Of New Jersey in the United States Distict Court in Newark, New Jersey. The case had to do with the unconstitutionality of the child custody laws in New Jersey.

At the time I was litigating my case against the State of New Jersey there were three other men that were suing the State of New Jersey on the same issue but from a different perspective.
They were Robin Kelley, Carlo Basile and Don Smith. Robin Kelley, Carlo Basile and I , Joseph Barbier filed our complaints in the United States District Court in Newark, New Jersey and Don Smith filed his complaint in the Federal Court in Camden, New Jersey. Carlo Basile was the first one to be dismissed by the court because he did not prepare his papers properly. Robin Kelley was the second one to be dismissed by the Court because I believe he was asking for a googooplex as damages for not seeing his child. Don Smith was then dismissed. In the case that Don Smith was litigating the Federal Judge in his case in Camden demanded copies of his Federal Income Tax Records, Don Smith, who belonged to the Sons of The American Revolution said the Judge had no right to his income tax records. The Judge in his case therefore had Federal Marshals transport Don Smith to the Tombs in New York City where he remained for five months twenty-nine days and twenty hours. The government let him out of jail four hours before six months were up because he could have sued the government for an undetermined amount of money if they kept him in the Federal Prison over six months and Don was ready to file suite. My case was dismissed as I have stated, I took it to the United States Court of Appeals for the Third Circuit then I ran out of money.

Since then my friend Don Smith has passed away a few years ago. He was conservative, principled and a very religious gentleman, to whom his son was everything.

My friend Carlo Basile passed away on March 5, 2005 he was a true friend, compassionate, supportive and emotional. To him his three sons were everything. To him Family and close friends were everything. He loved everbody and would not hurt a soul.

I have no idea where my friend and fellow advocate Robin Kelley is but I wish him well. I remember he was planning to take the State of New Jersey and the United States Government to the International Court in La Hage. Robin at the time we were advocates had one son that was everthing to him. Robin was liberal in his values with outstanding compassion and support for his friends and mostly his son Jesse.
